The Accra Supreme Court, presided over by Judge William Bempong, overturned an earlier order to close Senyo Hosi’s defamation lawsuit against Kennedy Agyapong in 2017.
On July 12, lawyers for Senyo Hosi, chief executive of the Chamber of Bulk Oil Distributors, were not in court when lawyers for Asin’s lawmaker Kennedy Agyapong asked the court to drop the case.
The court said today that the MP’s lawyers failed to draw attention to some important facts on July 12, which led to the wrong deletion of the case.
He therefore rejected all arguments of MP Rafael Agyapong’s lawyer against the reopening of the case.
Judge Bempong also emphasized that the deletion of the case was wrong, as Mr Hosi and his lawyers had never been informed of the rescheduling of the case for that day after missing the earlier adjourned date.
Senyo Hosi’s lawyer claims that the development is “strange” because the MP and his lawyers did not comply with the orders to testify in 2019 and did not do so until March this year.
Samson Lardi Annieni said the court was ready to proceed with the case to begin the trial in 2020, but he generously turned to the MP and his lawyers only to appear for the last time and act in bad faith.
He added that Mr Agyapong’s lawyers had behaved badly, as his company had sent six different cases where they had not attended court and did not know the next adjourned date.
The case was adjourned to Wednesday, October 20, 2021, at 9 a.m. so that management could pave the way for the trial to begin.
